Thank you for visiting the Web site of Dreamers Adventure Tours (DAT). By using this Web site and/or booking travel products through DAT, you agree to the Terms, Conditions and Notices below on behalf of yourself and any person using your account to book such products. Please carefully read these terms, conditions and notices. View Dreamers Adventure Tours privacy policy that applies to the use of this Web site and any travel bookings hereunder.

Dreamers Adventure Tours is in collaboration with Aegea Adventures, Inc. (AA) of Greece. A number of companies operate under Aegea Adventures, Inc., as d/b/a companies, including CycleGreece, Greece By Foot and Sea Greece. This Agreement shall encompass these d/b/a companies as well via the umbrella company, Aegea Adventures, Inc., a corporation registered in the State of New York.

Use of this Website
Use of Online Booking Feature: The "Booking Feature” of this Web site is provided solely to assist you to shop for DAT/AA travel, and for no other purposes. You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use this Web site in accordance with all terms and conditions herein. Personal and Noncommercial Use Limitation: This Web site is for your personal and noncommercial use. The content and information on this Web site (including, without limitation, price and availability of travel services), as well as the infrastructure used to provide such content and information, is proprietary to DAT or its suppliers and providers. Accordingly, as a condition of using this Web site, you agree not to use this Web site or its contents or information for any commercial or non-personal purpose (direct or indirect). While you may make limited copies of your travel itinerary (and related documents) for travel or services booked with DAT/AA with the assistance of this Web site, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information obtained from this Web site. In addition, whether or not you have a commercial purpose, you agree not to: (i) access, monitor or copy any content or information of this Web site using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of DAT; (ii) violate the restrictions in any robot exclusion headers on this Web site or bypass or circumvent other measures employed to prevent or limit access to this Web site; (iii) take any actions that imposes, or may impose, in the discretion of DAT, an unreasonable or disproportionately large load on the DAT infrastructure; or (iv) deep-link to any portion of this Web site for any purpose without express written permission of DAT.

Travel Bookings
You agree to be financially responsible for all of the travel products or services booked through your account with DAT/AA. In addition, you warrant that all information supplied by you or anyone using your account to DAT/AA in connection with the booking of travel products is true and accurate. Without limitation, any speculative, false, or fraudulent reservation, or any reservation made in anticipation of demand is prohibited. You agree to only make legitimate travel services bookings for you or for another person for whom you are legally authorized to act.

Prices
Tour prices for Greece are "anchored" in euros, meaning the dollar value of the tour is whatever the exchange rate is on the date of your deposit or tour payment. Prices are subject to change without notice. Prices are quoted per room/double occupancy and on an individual-component basis. Single Supplements are listed when available. All applicable taxes are included in the price of the vacation. Fees or other charges such as surcharges or taxes imposed by the airline after your vacation purchase (if any), however, will be your responsibility. Some airport departure fees may not be included and must be paid directly to the airline.

Payments
For all bookings made 90 days or more prior to departure, a deposit of 400€ per person (about $500) is required by DAT/AA at the time you make your reservation. Final payment is due 90 days prior to departure. Full payment is due immediately for bookings made in 90 days or less of departure, and in these instances a 200€ (about $250) handling fee may be applied. Hotels may require full payment at time of booking for high-demand periods. Villas and yachts require a 50% deposit at time of booking. Some published airfares may require full payment and immediate ticketing.

Forms of Payment
Payment may be made through a Dreamers Adventure Tours sales representative by American Express, MasterCard, or Visa credit card or via our online booking system.

Last Minute Bookings
DAT/AA accepts last-minute reservations provided space is available and full payment has been received, and in such instances a 200€ (about $250) handling fee may be applied. Non-refundable express-mail charges may apply.

Price Protection
All bookings are price-protected upon receipt of deposit by DAT/AA, or when full payment is received for the entire booking prior to any price changes. Tax changes, surcharges, and consumer-initiated changes are not price-protected.

Change & Cancellation & Refund Fees
Cancellations must be made by fax or email. Upon the office's receipt of said cancellation notice, DAT will fax or email an acknowledgement within 48 hours of said cancellation notice. The date of the cancellation notice is the date said notice is received by DAT/AA.

DAT/AA's refund policies are as follows:

From booking date to 90 days prior to starting date of tour: 80% refund of the amount of deposit.
Between 90 days and 60 days prior to starting date of tour: 50% refund of total amount.
Between 60 days and starting date of tour: no refund
Voluntarily leave of the tour at any time after the first day: no refund
Involuntarily leave of the tour upon demand by AA for inappropriate behavior: it is in AA's discretion to refund or not, and in what amount
Any omission or refusal of services paid for as part of the tour but not patronized does not qualify for any refund.
If airfare is booked through AA's affiliates, unused portions of airfare are nonrefundable. Nonrefundable airline tickets will not be refunded once ticketed. Refundable airline tickets must be canceled before ticketed departure date. No refunds on all ticketing service fees or express-mail fees.

Amended Bookings

Booking amendments (e.g., choice of tour or change of dates) are acceptable so long as there is an availability for the other tour and the request comes 60 days or more prior to the starting date of the initial tour. In that event, there is a 100 euro (about $125) per person handling charge. This charge does not apply if DAT/AA reroutes your booking to a tour other than the one you chose in case your tour does not meet the minimum number of tour participants. Tour substitutions made less than 60 days before the starting date of the initial tour will be treated like a cancellation (see cancellation policies above). Bookings transferred to another person are charged a 100 euro (about $125) handling fee per person per change subject to the time frame and conditions mentioned above. No changes to the original booking will be permitted within ten days of tour's starting date.

Tour Cancellation by DAT/AA
DAT/AA reserves the right to cancel at any time, including a confirmed tour. DAT/AA confirms a tour once it has the minimum number of fully paid travelers necessary for each tour which is 10 clients. In the unlikely event that AA cancels a tour for any reason, all booked clients on said tour have the choice of joining another tour or receiving a full refund of sums paid to day, and said refund shall constitute full settlement. DAT/AA is not responsible for expenses incurred by participants in preparation for a trip: nonrefundable air tickets, equipment, etc. Exceptions to this policy cannot be made for any reason, including weather, personal emergencies, family deaths, Acts of God, labor strikes, or any events which make it impossible or infeasible for AA to continue the scheduled tour. DAT/AA strongly urges purchase of travel insurance. Ask about discounts for travel insurance when purchased through our insurance affiliate.

Changes in Schedule
DAT/AA will make all reasonable efforts to ensure that the tour goes forward as planned and represented. However, AA reserves the right to make changes in the schedule or itinerary of a tour without incurring any refund obligations as a result of unexpected occurrences. Changes in tour services, including but not limited to hotels, tour routes, modes of transport, or end destinations, may be altered at AA's discretion, and this is particularly so when said changes are due to the weather, Acts of God, labor strikes or other external forces outside AA's control that may affect the tour's schedule. Adventure travel tours require a degree of flexibility and unexpected changes may arise due to local circumstances. In the event the tour is affected by external forces that upset the tour schedule AA will make every possible effort to find alternate ways to maintain the tour schedule, and any additional costs incurred by such arrangements will be the responsibility of the client.

Force Majeure
DAT/AA and its affiliates have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control. In all cases, DAT/AA and its affiliates have no responsibility for any additional expense, omissions, delays, re-routing, or acts of any government or authority.

Rules and Regulations on Travel Products
Separate Terms and Conditions of Travel Products and Services: Separate terms and conditions will apply to your reservation and booking of travel-related goods and services that you select. You agree to abide by the terms or conditions imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of fares, products or services. You understand that any violation of any such supplier's conditions may result in cancellation of your reservation(s) or booking, in your being denied access to any flights, hotels or automobiles, in your forfeiting any monies paid for such reservation(s) or booking, and in AA debiting your account for any costs AA incurs as a result of such violation. You will be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your booking of travel products and services from AA.

Air Transportation
In the event you purchase your airline ticket through DAT/AA's travel affiliates, note that no refunds are allowed on unused portions. Changes to flight itineraries may result in an increased airfare, a carrier-imposed charge or, in some instances, may not be permitted. Once travel has commenced, routing and/or class-of-service changes are not permitted. Additional cancellation fees are assessed by the airline on special fares. DAT/AA passengers are subject to all airline limitations, liabilities, and tariffs. All air carriers booked by AA shall be liable only as common carriers to DAT/AA passengers. DAT/AA is not responsible for schedule changes or airline strikes. Some countries charge a separate departure tax that is collected at the airport and typically must be paid for in the local currency. This tax is not included in your fare. Name changes are not allowed. AA is not responsible for multiple connections due to schedule changes. DAT/AA strongly recommends the purchase of Travel Insurance to avoid travel related contingencies.

Physical Disabilities
Any physical disability requiring special attention, treatment, or facilities must be communicated to DAT/A when the booking is made.

General

Warranty & Liability Disclaimers
The air carriers, hotels and other suppliers providing travel or other services for DAT/AA are independent contractors and not agents or employees of DAT/AA or its affiliates. DAT/AA and its affiliates are not liable for the acts, errors, ommissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage or other damages or expenses resulting thereform, in no event shall DAT/AA, its affiliates and/or their respective suppliers be liable for any indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of this web site or with he delay or inability to use this web site or any travel product booked by you, or otherwise arising out of the use of this web site or booking of travel products by you, whether based on contract, tort, strict liability or otherwise, even if DAT/AA, its affiliates, and/or their respective suppliers have been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitattion of liability for consequential or incidental damages, the above limitation may not apply to you. The laws of Greece apply to all tours. In addition, in no event shall the total cumulative liability of DAT/AA, its affiliates and/or their respective suppliers to you, any traveler from whom you booked travel, or any other third party arising from or related to this agreement exceed the greater of (I) one hundred dollars ($100.00) and (II) the amount that you paid to DAT/AA hereunder for the travel that is the subject of the dispute. Indemnification: You agree to defend and indemnify DAT/AA, its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal and accounting fees, brought by: (i) you or on your behalf in excess of the liability described above; or (ii) by third parties as a result of: (a) your breach of these Web Site Terms, Conditions and Notices or the documents referenced herein; (b) your violation of any law or rights of a third party; or (c) your use of this Web site or booking of travel products through DAT/AA.

Modification of these Terms and Conditions
DAT/AA reserves the right to change the terms, conditions, and notices under which this Web site and its travel products are offered, and you agree to accept and be bound by those terms, conditions, and notices that are in effect at the time of your booking of travel with DAT/AA.

Acknowledgments
At time of booking, client must acknowledge the following:

On an DAT/AA tour, from Day 1 to the final day, the client agrees to conduct him or herself in an appropriate manner.
The client shall accept the authority of the group leader(s) and local operators at all times.
The client understands that group travel is different from individual travel and that accommodation may be needed for the diverse needs and abilities of the group's members.
The client accepts that AA can reject the participation of any traveler who acts in an irresponsible or inappropriate manner.
The client accepts and understands that he or she must obey all laws of the territory visited, and AA will not assume liability for any client's unlawful conduct.
The client understands that a host of third parties, such as hotels, ferry boats, restaurants, coaches, etc, play a role in making each tour happen, and that AA cannot be held acountable or liable for third parties conduct. Although DAT/AA represents that it contracts with reliable, professional and responsible third parties, in the event such third parties cause injury, damage, loss, delay or irregularity, AA cannot accept responsibility or liability for third party actions.
On cycling tours, if you bring your own bike, DAT/AA is not responsible for any damages that may occur in the normal course of a tour, or theft. If you use one of AA's bikes in an abusive, irresponsible or negligent manner, you are responsible for any damages to or theft of the bike.
If client is booking on behalf of other travelers, he/she has authority to fully bind on all travelers in client's party.
Booking Agreement signed by the client is governed by the laws of Greece.
No employee, agent, servant or representative of AA has authority to alter the conditions set forth herein


Insurance and Release
Although highly recommended, purchase of travel insurance is not required in order to travel with DAT/AA (except for dedicated family tours). If you do not purchase travel insurance it shall be a condition to booking that you sign a waiver stating same at the time of booking. No reimbursements shall be received from AA for any interruptions, delays, cancellations, medical emergencies or other problems arising out of or related to travel and the tour. AA assumes no responsibility or liability for any loss or damage of personal effects or for any injury or loss during the duration of the tour. AA recommends the purchase of travel insurance. Ask about discounts for travel insurance when purchased through our insurance affiliate.

Waiver and Release

A Client who books a tour on behalf of other travelers fully binds this Agreement on all travelers in the Client's party. Nonetheless, all adults must sign this Agreement individually and for any child 18 and under who accompanies them on a tour. All clients shall be obligated to sign a release and failure to so sign shall be grounds to exclude the client from the tour with no refund.

I understand that I am voluntarily taking either an active tour or a leisure tour with Dreamers Adventure Tours/Aegea Adventures and that an active tour may have more complications than a conventional vacation due to the physical activities involved. I have provided Dreamers Adventure Tours/Aegea Adventures with information fully disclosing my current and/or pre-existing medical conditions. I accept and assume the risks entailed in an active or leisure tour, and I release Dreamers Adventure Tours, LLC and Aegea Adventures, Inc. and any of its divisions, including CycleGreece, Greece By Foot or SeaGreece from any liabilities to the maximum extent permitted by law.

Note: When booking a tour online, this Agreement, Waiver and Release is deemed signed when the Agreement box is checked.
